The Data Act – Your Journey, Your Data, Your Control!

The Data Act explained

You may have rights under the Data Act if you are in the EU and you:

  • Own a connected product (like a connected vehicle), or
  • Have a contractual right to use a connected product (maybe you're leasing a connected vehicle), or
  • Use a related service of a connected product (such as the FordPass app).

If you fit into one of these categories, the Data Act gives you two main rights in relation to the data generated by your use of a connected product or related service:

  • Access: You have the right to access this data yourself.
  • Share: You can share this data with a third party of your choice located in the EU.

Importantly, these rights do not apply to all data generated by the product or service. Think of the data as the basic, raw information directly from your usage, such as vehicle or charging data, which is readily available to us.  Insights, analysis or new data we create are all excluded from the Data Act.  More information about the data can be found below.

Remember, if you are thinking of sharing your data with a third party:

  • They must be located in the EU.
  • Choose someone you trust!
  • It's wise to have an agreement with them about how they'll use your data.
  • Just so you know, the law allows us to charge the third party (not you) if we send the data directly to them for you.

The Data

Categories
The data available from your connected product or related service will vary depending on your vehicle model, your subscriptions, the features you have enabled and your chosen settings.  The data will fall into one of these categories:

  • Vehicle Data: Core vehicle performance and system status such as battery levels, fuel, mileage and coolant temperature.

  • Vehicle Health:  Diagnostic and maintenance-related information such as tire pressure, oil life and diesel exhaust system status.

  • Driving Data:  How the vehicle is operated and used such as speed, acceleration, braking and seat belt use.

  • Vehicle Location:  Positional and movement data such as GPS coordinates, compass direction and GPS speed.

  • Electric Vehicle Data:  Key electric vehicle metrics such as battery charge level, energy capacity, temperature and motor voltage

  • Charging Data:  Information related to the vehicle’s charging process such as time and duration of charge, voltage, current, charger type and plug status.  This may also include charger data, if available.

  • Trip Data:  When you use navigation or trip planning features, journey information such as route, fuel consumption, total distance and electric-only travel range.

  • Vehicle Security:  Status of security systems such as alarms, door locks and window position.

  • Speciality Vehicle Manufacturer Data:  High-level details about Specialty Vehicle Manufacturer installed modules, including input and output status of those modules.

Remember, if your product is not connected, for example, or if you have not activated your vehicle with FordPass, it will not be able to send any data. If no data is being sent, then we do not have any data for you to access or share under the Data Act.

Technical Information

The information below will help you understand more about the technical aspects of the data, such as format, volume and cadence.  Please remember that these will vary depending on the model of your connected vehicle, subscriptions and chosen settings.

  • Format.  The data is delivered in the JSON (JavaScript Object Notification) format which is a standard, easy-to-use, text file format.

  • Volume. The volume of data generated can vary but may be up to 1 GB.

  • Frequency. Some data can be generated and delivered in real-time and continuously.  Data collection frequency varies from every few seconds to event-based (such as at key on and key off).

  • Storage.  Data is stored securely in Ford’s cloud for 7 days. Depending on the connected product or related service, data may be retained for a longer period in line with Ford’s data retention policy. For details, please refer to the Terms for the specific connected product or related service, and the relevant privacy policies. Certain data may not be stored in Ford’s cloud and is only stored on the vehicle.

  • Purpose & Use. Ford uses the data for the purposes outlined in our relevant terms and conditions and privacy policies for the Connected Products and Related Services. The terms and conditions also explain the duration of the contract and how you can terminate the services if you wish.

  • The data may contain Ford’s trade secrets.  To learn more about trade secrets, please see FAQ.
